Credit Card Debt Collection Cases

The extremely high number of collection cases has required the Court to establish procedural guidelines under Administrative Order 2010-9 setting forth specific protocols that must be followed in order to keep the case active and brought to a successful conclusion.

  1. When service has been effected upon the Defendant and an answer has not been filed, the Plaintiff is instructed to enter a judgment within 90 days.
  2. If service has been effected and an answer has been filed timely the parties are directed to complete discovery within ninety (90) days.
  3. Ninety (90) days thereafter the Plaintiff is required to praecipe the case for arbitration.
  4. The Prothonotary has been directed to discontinue all credit card debt collection cases that possess one hundred eighty days (180) of continued inactivity.
